2. BIR ANNOUNCES THE AVAILABILITY OF THE OFFLINE eBIR FORMS PACKAGE VERSION 7.9.4.1
Revenue Memorandum Circular (RMC) No. 122-2023, issued on December 1, 2023, announces the availability of the improved version of the offline eBIRForms Package Version 7.9.4.1. The new version updates the Alphanumeric Tax Code (ATCs) in BIR Form 1702-RT, the income tax rate on BIR Forms 1700, 1701, and 1701A, and bug fixes on BIR Form 1702-MX.
3. BIR ANNOUNCES NEW FEATURES OF ORUS\
Revenue Memorandum Circular (RMC) No. 121-2023, issued on November 29, 2023, announces additional features and functionalities of Online Registration and Update System (ORUS) starting November 21, 2023. These include Tax Identification Number (TIN) inquiry, access to digital TIN ID, and an online payment facility MyEG.
4. BIR CIRCULARIZES THE AVAILABILITY OF DIGITAL TIN ID
Revenue Memorandum Circular (RMC) No. 120-2023 issued on November 29, 2023, announces the availability of the Digital Tax Identification Number (TIN) as an additional functionality and feature of the BIR Online Registration and Update System (ORUS) starting November 21, 2023. Instead of visiting and falling in line in BIR Revenue District Offices to secure a physical TIN card, taxpayers are advised to secure the Digital TIN ID online. The circular also highlights the policies and guidelines prescribed for the use and acceptance of the BIR Digital TIN ID.
5. DOJ OPINION
APPEALS TO THE COURT OF APPEALS (CA) DO NOT AUTOMATICALLY STOP THE HUMAN SETTLEMENTS & ADJUDICATION COMMISSION’S DECISIONS UNLESS THE CA ISSUES A SPECIFIC ORDER TO PAUSE THEM
The Human Settlements and Adjudication Commission (The Commission) is requesting an opinion on the proper interpretation of Sections 15 and 18 of the Republic Act (RA) No. 11201, otherwise known as the “Department of Human Settlements and Urban Development Act,” to guide litigants and the Commission in the enforcement of its decisions. The Commission stated that there seems to be a conflict between the two provisions specifically whether the decisions of the Commission En Banc become immediately final and executory after the lapse of 15 calendar days from receipt thereof by the parties, regardless of whether an appeal is filed with the Court of Appeals (CA), in the absence of a Stay Order from the court. In reply, the Department of Justice (DOJ) clarified that unlike in ordinary cases where the appeal shall stay the judgment or final order unless the CA, the law or the Rules of Court shall provide otherwise, under R.A. No. 11201, the Decisions of the Commission En Banc become final and executory after the lapse of 15 calendar days after parties receive them, in the absence of a Stay Order from the CA. The right to appeal is not an absolute right but a legal privilege. Those appealing must strictly follow the court rules. Thus, if the rules state decisions are not paused during an appeal unless the CA orders it, the appealing party must follow these rules.
